These terms and conditions (the “Terms and Conditions”) govern the use of www.hankerie.com (the “Site”). This Site is owned and operated by Hankerie. This Site is an ecommerce website.

By accessing and using this Site, you indicate that you have read, understood, and agree to comply with and be bound by these Terms and Conditions and our Privacy Policy (available separately on the Site) at all times.

1. Definitions

  • “Site” refers to www.hankerie.com
  • “Hankerie”“We”“Us”, or “Our” refers to the owner and operator of the Site.
  • “User”“You”, or “Your” refers to any person accessing or using the Site.
  • “Goods” refers to the products available for sale on the Site.
  • “Services” refers to the workshops or other services available for booking/purchase on the Site.
  • “ACL” refers to the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. Intellectual Property

All content published and made available on our Site is the property of Hankerie and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site. All rights are reserved.   

3. Age Restrictions

The minimum age to use our Site and purchase Goods or Services is 18 years old. By using this Site, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into a binding agreement. We do not assume any legal responsibility for false statements about age.

4. Acceptable Use

As a User of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of Hankerie or any third party to the Site;
  • Hack into the account of another user of the Site;
  • Act in any way that could be considered fraudulent; or
  • Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

5. Sale of Goods and Services

These Terms and Conditions govern the sale of Goods and Services available on our Site.

The following Goods are available on our Site:

  • Baking equipment needed to make Sourdough bread (e.g., banneton baskets, lames, whisks, scrapers, sifters, starter jars).
  • Packaged goods suitable for baking.
  • (Optional based on final starter kit configuration) Dehydrated sourdough starter.

The following Services are available on our Site:

  • In-home sourdough workshops (subject to location availability).
  • Sourdough workshops hosted by Hankerie.
  • Online sourdough workshops.

Workshop Services will be paid for in full when the Services are ordered, unless otherwise specified for a particular workshop offering. Specific cancellation and rescheduling policies may apply to workshops and will be detailed on the relevant booking page.

These Terms and Conditions apply to all Goods and Services displayed on our Site at the time you access it, including any products listed as being out of stock.

We strive to ensure all information, descriptions, or images provided about our Goods and Services are accurate and up-to-date. However, we cannot guarantee the absolute accuracy of all details (including colours displayed on your monitor). To the extent permitted by law, Hankerie is not bound by minor errors or omissions in information, descriptions, or images. You agree to purchase Goods and Services from our Site acknowledging this possibility. This does not limit your rights under the ACL (see Section 9).

We reserve the right to modify, reject or cancel your order whenever it becomes necessary (e.g., due to stock unavailability, pricing errors, or issues with payment). If we cancel your order after processing your payment, we will issue a refund equal to the amount you paid. You agree it is your responsibility to monitor your payment instrument to verify receipt of any refund.

6. Subscriptions (Email Newsletter)

By subscribing to our email newsletter, you agree to receive informational and promotional emails from Hankerie. Your email subscription will remain active until we receive notification that you wish to cancel.

To cancel your subscription, please follow the “unsubscribe” link and prompts located at the bottom of any email newsletter you receive from us.

7. Payments

We accept the following payment methods on our Site:

  • Credit Card (Visa, Mastercard, AMEX)
  • Direct Bank Transfer
  • Apple Pay

When you provide us with your payment information, you represent and warrant that:

  • You are authorised to use the payment instrument you have chosen;
  • The payment information you provide is true, correct, and complete; and
  • You authorise us (or our third-party payment processor) to charge the amount due to this payment instrument.

If we suspect your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

8. Shipping and Delivery (Goods)

When you purchase Goods from our Site, they will be delivered via Aramex or a nominated courier service. Available methods may include:

  • Standard Delivery (estimated 5-7 business days within Australia) depending on the courier company SLA

Delivery will take place as soon as reasonably possible, depending on the delivery method selected and order processing times. Delivery times are estimates only and may vary due to location, courier delays, or other unforeseen circumstances. Delivery times do not include weekends and public holidays.

Shipping costs are calculated at checkout based on order weight, dimensions, and delivery location. You are required to pay delivery charges in addition to the price for the Goods purchased unless stated otherwise.

You must provide us with a complete and accurate delivery address, including the recipient’s name. We are not liable for non-delivery or delivery to the wrong address or person if it results from inaccurate or incomplete information provided by you. Risk in the Goods passes to you upon delivery to your nominated address.

9. Consumer Guarantees and the Australian Consumer Law

Our Goods and Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure. For Services, you are entitled to have the service remedied if it is not provided with due care and skill or is not fit for purpose.   

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any of your rights under the ACL or any other applicable consumer protection legislation that cannot be lawfully excluded or limited. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and mandatory legislative provisions, the legislative provisions will prevail.

10. Limitation of Liability

To the maximum extent permitted by law, and subject always to your rights under the Australian Consumer Law (Section 9), Hankerie and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees arising from:   

  • Your use of the Site;
  • Your purchase or use of Goods or Services obtained through the Site (except as provided under the ACL); or
  • Your breach of these Terms and Conditions.

Our liability for any breach of a condition or warranty implied by the ACL is limited, where permissible, to the replacement of the Goods or Services, the supply of equivalent Goods or Services, the repair of the Goods, or the payment of the cost of replacing or repairing the Goods or acquiring equivalent Goods or Services.

11. Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Hankerie and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.   

12. Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.   

13. Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.   

14. Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users of significant changes by email (if you have provided one) or by posting a notice prominently on our Site indicating the date of the latest update. Your continued use of the Site after changes are posted constitutes your acceptance of the amended Terms and Conditions.
